Am I entitled to unemployment insurance benefits if I am unable to return to my regular employment?
Answer:
If you’ve been injured on the job and are receiving workers’ compensation benefits, so that you’re getting paid while you’re out of work, you won’t be able to draw unemployment benefits at the same time. South Carolina law actually says that to draw unemployment benefits, you have to sign a statement certifying that you’re able to work. If you’re drawing workers’ compensation benefits or you feel you’re not able to work, I would encourage you not to sign that statement because they will use that against you when you get an attorney who could make a claim for the workers’ compensation benefits. That’s one benefit you won’t be entitled to, but you have the other benefit to fall back on.
