A hit and run accident, otherwise known as leaving the scene of an accident, is a criminal law in South Carolina. This falls under Law 56-5-1220 and is a misdemeanor criminal offense. The most common penalties for leaving the scene of an accident in South Carolina are:
- Hit and run resulting in roadside damage: A misdemeanor punishable up to 30 days in jail and a fine of $100.
- Hit and run resulting in damage to unoccupied vehicles: Punishable jail term up to 30 days and $100 fine (plus other possible repair costs).
- Hit and run with damage to occupied vehicles: Punishable jail term up to one year and fine up to $5,000.
- Hit and run resulting in another person’s minor injury: Punishable up to one year and fine up to $5,000.
- Hit and run resulting in another person’s serious injury: No longer a misdemeanor, but a felony resulting in up to 10 years in prison and a max fine of $10,000.
- Hit and run resulting in another person’s death: A felony that carries up to 25 years in prison and a max fine of $25,000.
