If You’ve Been Injured by E-Cigarettes or Vaping, You May Have Recourse
Over 1,300 Americans have been diagnosed with vaping-related lung disease, and 29 have died as of October 14, 2019. Doctors have preliminarily linked this disease with the use of THC vape pods, though no long-term studies have been done to test this hypothesis. However, firsthand reports from many victims cite the use of THC-filled vape pods that aren’t sold in stores.
Vaping Can Cause Serious Harm
The US has seen 91% of vape-related lung disease cases lead to hospitalization, with some patients being re-admitted days or weeks after their first visit. Symptoms exhibited include:
- Coughing
- Shortness of breath or difficulty breathing
- Chest and abdominal pain
- Diarrhea
- Nausea and vomiting
- Fever
- Fatigue
- Weight loss
When examined, patients appear to have chemical burns in their lungs—much like damage that would be caused by inhaling poisonous gases. This damage seems to cause lung inflammation and could lead to dangerous infections.
Though doctors and reporters have been focused on vape-related lung disease, e-cigarettes come with other dangers as well. Users may be affected by:
- Seizures or other symptoms of extreme nicotine poisoning
- Vape pod explosions
- Increased risk for heart disease

False Advertising & Failure to Warn May Make Vape Manufacturers Liable
When Juul came on the scene, they promised their users two things:
- E-cigarettes were “totally safe,” much more so than regular cigarettes
- Their products could help people quit smoking without providing heavy risks
Neither of those claims are true. In fact, the FDA sent Juul a warning in early September asking them to amend their advertising practices or face sanctions. Neither Juul nor other e-cigarette manufacturers have provided studies that directly compare their products with cigarettes. However, scientists have found that even nicotine-free e-cigarettes may contain toxic chemicals—the exact thing these products were supposed to be free of. Further, Juul’s vape pods contain more nicotine than typical cigarettes, which may strengthen an addiction, not help people quit.

Youth Vaping Concerns
Juul has also been hit with lawsuits alleging they advertised to children—and with representatives presenting in schools, it’s an easy case to make. Fun, fruity pod flavors also appeal to younger audiences who may assume they are harmless. Many teens who have started vaping believe they are using nicotine-free pods. While these are available, a test showed that 40% of teens had unsuspectingly purchased pods containing nicotine. Nicotine can be highly addictive for anyone under the age of 25 and teen vaping may graduate to cigarette use—the exact opposite of the “benefits” Juul advertised.
Nicotine use may have affects other than increased cravings on youth who vape. It may also interfere with brain functions such as:
- Focus
- Memory
- Learning
All of these are especially important to teens who are still in school and, along with the risks that a progression to cigarettes would bring, can have lifelong effects on young vape users.
Vape Manufacturers Facing Legal Consequences
School districts, counties, states, and individuals have filed lawsuits against Juul alleging egregious wrongs by the company. Their reasons include:
- Marketing toward teen audiences and making false claims
- Suffering addiction despite Juul’s claims of “safety”
- Experiencing nicotine poisoning symptoms such as stroke or seizure
- Not receiving warnings of the dangers associated with Juul products and use
Many states or localities have banned stores from selling flavored vape pods, but for those injured by or addicted to e-cigarettes, much of the damage has already been done.
